Syllabus

<p>Practice, O. P.— Charge of court — Secret instructions to jury.</p> <p>Instructions to tlie jury must be given in open court where they may be heard by the parties and their counsel.</p> <p>It is error for the trial judge in the absence of the parties and their counsel to send written instructions to the jury after they have retired, although sentón answer to a written request from the jury for instructions.</p>
