<p>Street Railways — Collision with Wagon — Contributory Negligence — Question por Jury. In an action for injuries sustained by tbe driver of an express wagon in a collision with a street car in tbe business district of a large city, the plaintiff is not guilty of contributory negligence, as a matter of law, in assuming that be can cross tbe street car tracks in safety, where it appears that before crossing be looked back and saw tbe street car half a block away, approaching on an up grade, at ordinary speed, and tbe fender of tbe car struck one of tbe rear wheels of tbe wagon, tbe motorman not having slackened the speed of tbe car.</p>
