Syllabus

<p>Principal and surety—proof of request by thefoi'mer. In an action by a surety, in an appeal bond, against his principal, to recover for money paid by the plaintiff for the use of the defendant, proof of the fact that the principal appeared in the appellate court and defended the suit in which the bond was given, will justify the inference that the surety signed the bond at the request of the principal.</p>
