Syllabus
<p>Abatement and Revival Continuance against successor in interest. Process.</p> <p>Where, during the pendency of a suit, one of the defendants, a necessary party to the suit, died and the court entered an order reviving the suit against her heirs, a judgment without service of process upon such heirs or their voluntary appearance, was without authority, until the heirs of the deceased were properly brought in.</p>
