Syllabus

<p>ACCOUNTS STATED — PRESCRIPTION—APPLICATION OP PAYMENTS.</p> <p>1. The change in the law made by Act No. 78 of 1888, amending and re-enacting Rev. Oiv. Code, art. 3538, consists in applying the prescription of three years to accounts stated or rendered, and verbally or tacitly acknowledged, as well as to the “open” accounts to which it had previously applied.</p> <p>■2. Where money' and merchandise are drawn and received upon a running account, upon which there is a past-due balance, and upon which current entries are also being made, to the credit of the party so drawing and receiving, the payments so made, in the absence of instructions from the debtor, will be imputed to the debt longest due; i. e., the past-due balance.</p> <p>(Syllabus by the Court.)</p>
