SHUEN, 19 I&N Dec. 161 (BIA 1984) ID 2977 (PDF) (1) A preliminary injunction against enforcement of the amended regulation that revises the procedure for imposing a condition in an alien's appearance-and-delivery bond prohibiting unauthorized employment, 8 C.F.R. Sec.Sec. 103.6(a)(2)(ii)-(iii)(1984), does not automatically cause the original version of that regulation to be revived. (2) The Immigration and Naturalization Service may not rely upon a regulation that is no longer in effect to impose a condition in an alien's bond prohibiting unauthorized employment.
