Syllabus

<p>Res Judicata—Estoppel—Ejectment—Public Land.—A plaintiff in ejectment based his right upon a certificate of purchase from the State, the defendant based his right upon a homestead claim from the United States; the plaintiff had judgment. Afterwards the defendant brought an action to quiet title against the plaintiff, and offered to show that after the former judgment it had been determined in a contest in the United States land office that the land was public land of the Unifed States, and had never been lawfully selected by the State. Held, that the former judgment was conclusive between the parties that the State selection was valid.</p>
