Syllabus

<p>Municipal contracts — Sewers—Right to use materials on default of contractors.</p> <p>Where a municipal contract for a sewer provides that in case of default by the contractor the city shall have the right to complete the sewer at the expense of the contractor “and use such materials as may be found on the works,” the city has the right, on such default, to use the materials. In such a case, unless rejected by the city, the contractor has no right to dispose of the materials to other parties.</p>
