<p>Sewers — Report of viewers — Assessments for cost of sewer — Appeals— Act of May 16,1891, P. L. 75 — Practice, C. P.</p> <p>Where a jury of view -assess benefits exclusively to pay the costs and expenses of a sewer, but award no damages for property taken or injured, and make no assessment of benefits to pay damages for property taken and injured and there is nothing on the record to show that any property was injured, a property owner against whose property an assessment was made, cannot maintain an appeal in the court ctf common pleas and demand a jury trial on a statement which merely asserts that the viewers had made an excessive assessment for benefits and that the assessment against the city ought to have been larger.</p>
