<p>[Marked to be reported.]</p> <p>JSiegligenee — Gang plank on steamboat — Mere accident.</p> <p>The presence of the gang plank o£ a steamboat lying flat upon its surface in the usual place on the deck of the vessel, across the path to a staircase leading from the lower to the upper deck, is not a fact sufficient in itself to entitle a passenger who has stumbled over the plank to recover damages from the owner of the steamboat for the injury sustained.</p> <p>Mr. Justice Steeristt dissented.</p>
