Syllabus
<p>1. Pleading and evidence—in suit upon a bond against school directors. A party seeking to charge school directors, in their corporate capacity, ou a bond executed by them, must aver in his declaration and prove upon the trial, facts which show it was issued within the powers given them by the statute.</p> <p>2. So a declaration in a suit on such bond which fails to aver that the bond was given under authority of a vote of the people for one of the purposes named in the statute is insufficient.</p>
