Syllabus
<p>Principal and surety — Extension of time — Discharge of surety.</p> <p>A surety on a judgment note is not discharged by the debtor giving to the creditor a promissory note for the same debt, extending the time of payment, if it is expressly agreed between the debtor and creditor that the giving of the promissory note shall not in any manner impair the judgment note, or extend the time for its payment.</p>
