<p>SYLLABUS BY THE COURT.</p> <p>I. Banks — Subject to Police Power. The business of banking- is so intimately related to the public welfare that it properly falls within the scope of the police power of the state exercisable by the legislature.</p> <p>2. -Statute Authorizing Charter Board to Refuse Charter Valid. Section 2. of chapter 125 of the Laws of 1911, relating to the formation of private corporations and providing that the charter board shall refuse a bank charter if upon examination it shall make a determination against the public necessity of the business in the community in which it is sought to ■ establish the bank, is a valid enactment under the police power of the state.</p> <p>3. - Charter to First Applicant. Where equally meritorious applications for charters for several banks in the same community are pending before the charter board at the same time, and the charter board determines against the necessity for more than one bank, the application first presented should be granted.</p>
