Syllabus

The defendant appealed from a judgment entered in favor of the plaintiff for the payment of room and board and routine nursing services provided by the plaintiff to the defendant's mother. The Supreme Court concluded that, pursuant to the clear and unambiguous language of an admission agreement, the defendant agreed to be personally liable for any and all amounts due to the plaintiff. The Supreme Court also concluded that the defendant failed to present any evidence that the plaintiff did not act in good faith or mitigate its damages and that she, as the nonmoving party opposing summary judgment, bore the burden to present competent evidence showing the existence of a disputed issue of material fact. The Supreme Court therefore affirmed the judgment of the Superior Court.
