Syllabus
<p>Where justice of the peace has exclusive jurisdiction — Appeal taken from judgment of justice to common pleas — Petition need not allege taking of appeal — Competency of testimony as to habits of a dog.</p> <p>1. If in a civil action of which a justice of the peace has exclusive original jurisdiction, an appeal is taken from the judgment of the justice to the court of common pleas, it is not necessary to the jurisdiction of the appellate court that the petition allege the fact that such appeal had been taken.</p> <p>2. It is competent to prove that a dog had acquired a habit of attacking sheep, in support of a disputed allegation that he attacked and injured sheep on a particular occasion.</p>
