<p>SYLLABUS BY THE COURT.</p> <p>Damages — Assault and Battery — Several Defendants — Set-off in Favor of One Defendant Only — When Permissible. Where several defendants are sued by the plaintiff upon the charge of having committed an assault upon him, a claim against him for having alienated the affections of the wife of one of the defendants may be interposed as a set-off, where the answer shows a waiver of all right to affirmative relief.</p>
