ROTIMI, 24 I&N Dec. 567 (BIA 2008) ID 3616 (PDF) An alien has not \lawfully resided\ in the United States for purposes of qualifying for a waiver of inadmissibility under section 212(h) of the Immigration and Nationality Act, 8 U.S.C. § 1182(h) (2006), during any periods in which the alien was an applicant for asylum or for adjustment of status and lacked any other basis on which to claim lawful residence.
