The plaintiff, Ronald J. Resmini, appealed from the Superior Court's grant of the motion to dismiss of the defendant, Verizon New England Inc. The plaintiff had filed a complaint that alleged fraudulent misrepresentation and breach of contract on the grounds that he had allegedly been charged for a burglar alarm service that had become inoperable.<br><br>The Supreme Court held that the motion to dismiss should have been treated as a motion for summary judgment. The Court further held that the motion for summary judgment should have been denied due to the presence of disputed issues of material fact. Accordingly, the Supreme Court vacated the judgment of the Superior Court and remanded the case for further proceedings.<br><br><br>
