<p>SYLLABUS.</p> <p>1. The finding of facts by a trial court will not be disturbed unless it is clearly against the weight of the evidence.</p> <p>2. When a case is tried to the court, the court is the sole judge of the credibility of the witnesses and of the weight to be given to their testimony.</p>
