Syllabus

Trial court did not rely on inadmissible hearsay evidence when it granted appellee's motion for summary judgment. The record establishes that the trial court relied on appellant's own sworn deposition testimony when it granted summary judgment to appellee. The trial court did not err when it granted appellee's motion for summary judgment with respect to appellant's claims for 1) abuse of process 2) malicious prosecution 3) intentional infliction of emotional distress 4) frivolous conduct and 5) to declare appellee a vexatious litigator. Judgment affirmed.
