<p>SYLLABUS BY THE COURT.</p> <p>1. Negligence — Personal Lujuries — Weighing Circumstantial Evidence. Ordinarily, in civil cases, a preponderance of the evidence — the greater convincing weight — controls whether the evidence be direct or circumstantial.</p> <p>2. Same — Special Questions — Not Fairly Answered. When special questions properly submitted are not fairly or consistently answered according to the evidence, a fair trial has not been had and a new trial should be granted.</p>
