Syllabus

<p>1. Public officers, such as sheriffs and constables, who overstep or abuse their powers, may be subjected to punitory or vindictive damages.</p> <p>2. A party injured by wrongful acts of public officers is always entitled to recover compensatory or actual damages; but if the acts be attended with malice, or be done under circumstances of aggravation and in violation of a plain right, the injured party may recover consequential and even punitory damages.</p>
