Syllabus

<p>Contract.—must befiilly performed. Under a contract for the delivery of a certain number of posts, of a specified quality and size, the party to whom the posts are to be furnished is not bound to receive a part of the posts contracted for, and if the party who was to furnish them delivers a less number, which are not received, he has no right of recovery.</p>
