ROCHA, 20 I&N Dec. 944 (BIA 1995) ID 3239 (PDF) An alien is not deportableunder section 241(a)(1)(A) of the Immigration and Nationality Act, 8 U.S.C.§ 1251(a)(1)(A) (Supp. V 1993), as an alien who was excludable atthe time of entry pursuant to section 212(a)(2)(C) of the Act, 8 U.S.C.§ 1182(a)(2)(C) (Supp. V 1993), where the examining immigration officerdid not know or have reason to believe at the time the alien was inspectedand admitted into the United States that he was an illicit traffickerin any controlled substance.
