<p>[To be reported.]</p> <p>A parol promise by a third person, that if the promisee will forbear eviction of his tenant for non-payment of rent, and permit the tenant to occupy the premises for the remainder of the term, the promisor will pay the rent, is within the operation of the statute of frauds and perjuries and unenforceable: § 1, act of April 26, 1855, P. L. 308; — Merriman v. McManus, 102 Pa. 102, distinguished.</p>
