The plaintiff, Richard Paiva, appealed from a Superior Court judgment in favor of the defendant, Lynne Corry, in her official capacity as warden of the maximum-security facility at the Adult Correctional Institutions. The plaintiff argued that the hearing justice erred in finding that the plaintiff did not plead a proper cause of action, in declining to find that a Department of Corrections policy has the force of law, in declining to issue a writ of mandamus, and in finding that the plaintiff failed to join an indispensable party. The Supreme Court has previously held that a writ of mandamus is not an appropriate remedy in this context. Therefore, having not been provided any transcripts and agreeing with the hearing justice that the plaintiff did fail to join an indispensable party, the Supreme Court affirmed the judgment of the Superior Court dismissing the plaintiff's amended complaint.
