Syllabus

<p>The action of the court in striking off a discontinuance, at the instance of the equitable plaintiff, is not reviewable in the supreme court, although the question of a settlement, by the legal plaintiff with the defendant, is involved. It is not a final judgment, and therefore not reviewable on writ of error.</p>
