Rajmonda Mile v. Kirkbrae Country Club

The plaintiff, Rajmonda Mile (Ms. Mile), sought review on certiorari of an order of the Superior Court that denied her motion to compel production of a videotape depicting her slip-and-fall accident on the premises of the defendant Kirkbrae Country Club (Kirkbrae). Ms. Mile argued that the videotape was not entitled to work-product protection, while Kirkbrae urged that this Court's decision in Cabral v. Arruda, 556 A.2d 47 (R.I. 1989), controlled. After issuing the writ, the Supreme Court held that the defendant had not met its burden to establish that the video was protected by the work-product privilege in the first instance and thus had not established its right to nondisclosure. Accordingly, the Supreme Court quashed the order of the Superior Court denying Ms. Mile's motion to compel and remanded the record to the Superior Court.
