Effect.</p> <p>In a suit for damages it is only where the plaintiff’s act is the sole cause of the injury and when defendant’s act is no part of the causation, that defendant is free from liability.</p> <p>2. Evidence.</p> <p>Under the facts in this case, as set out in its opinion, the court held that a servant’s death was the result of an accident and not caused by the master’s negligence.</p>
