<p>Municipal Corporations—Construction of Drain—Liability op Contractor—Flooding by Surface Water. A city contractor making a All in a street is not liable for tbe damages caused by water backing up in a depression and entering tbe plaintiffs cellar, where it appears that a box drain bad been put in under tbe supervision of tbe city engineer to carry off tbe water, wbicb was large enough to carry off tbe water ordinarily, but bad become clogged up on one occasion, and there was no evidence of negligence or knowledge on tbe part of tbe contractor or city that the drain was insufficient or bad become clogged or dammed up.</p>
