Syllabus
<p>Mines and mining — Right of way through coal reserved — Title to coal removed to make right of way.</p> <p>Where the owner of a tract of coal in conveying it reserves a certain portion, but gives to the vendee a right to make ways and passages through it to remove the coal conveyed, the vendee has the right to make the ways through the coal reserved, but he has no title to the coal itself which he removes in doing so, and for this he must account to his grantor.</p>
