Syllabus
<p>1. New Trial—Grounds—Matters Concluded by Verdict.</p> <p>Where there is a conflict of testimony between unimpeached witnesses on an issue, it is the province of the jury to determine such issue, and the court is not authorized to set aside their verdict, although It may believe the preponderance of evidence to be the other way.</p>
