Syllabus
<p>-SYLLABUS- (BY THE COURT.)</p> <p>1. The judgment of the District Court that the plaintiff have specific performance of the defendant’s written agreement to convey certain land to it, is not, strictly, open to reversal by this court, since it is based on substantial evidence; but even if it were so open, the weight of evidence would require the same judgment.</p> <p>2. The amount of the judgment for damages rendered in the District Court is not warranted by the evidence, and the cause is remanded for the correction of the judgment in that particular.</p>
