Syllabus

<p>It is not error in a Court to refuse an instruction asked, which assumes a certain fact to exist, respecting which evidence has been introduced before the jury.</p> <p>Where the evidence is conflicting the Appellate Court will' not reverse the order of the Court below denying a new trial.</p>
