PRADIEU, 19 I&N Dec. 419 (BIA 1986) ID 3021 (PDF) Where a spouse visa petition is filed in the New York District Office of the Immigration and Naturalization Service, it must be adjudicated in compliance with the procedures set forth underthe final consent judgment entered in Stokes v. INS, No. 74 Civ. 1022 (S.D.N.Y. Nov. 10, 1976), regardless of whether the visa petition has been submitted individually or simultaneously filedwith an application for adjustment of status.
