Syllabus

<p>Public Lands—Cancellation or Deed—Pasties. An action to cancel a deed of state lands cannot be maintained by a person who has no interest in the property, as the state is a necessary party plaintiff where the land reverts to the state.</p> <p>Same—Interest or Private Citizen. A private citizen, who was fraudulently prevented by state officers from bidding at a sale of state lands, has no such interest in the lands as to entitle him to maintain a suit to cancel the deed from the state, as he could not Tequire it to be resold.</p> <p>Same—Taxpayer. A taxpayer cannot maintain a suit to cancel a deed fraudulently made by state officers, as he suffers no injury different from that suffered by the public at large.</p>
