Syllabus
<p>1. Laches pleaded in behalf of the State.—In an action brought February 22, 1873, under an act of December 14, 1837, authorising suits against the State to settle the claims of empresarios: Held, that a demurrer was properly sustained, on the ground of laches in the prosecution of such claim.</p> <p>2. Limitation may be pleaded by the Attorney General.—It seems that the Attorney General may properly interpose limitation as a plea when the State is sued, even in cases where suit is allowed for the purpose of ascertaining the amount and validity of such claim.</p>
