Syllabus
<p>1. Building and Loan Association. — A loan made by. a building and loan association to one of its members is a loan and not a partnership-transaction, and all monies paid on stock whether before or after loan must be credited on debt.</p> <p>2. Contract — Place of Performance. — This contract was to be performed in North Carolina.</p> <p>3. Equity Cases — -Findings of Fact. — Will this Court hear equity cases de novo?</p> <p>4. Findings of Fact by Circuit Judge affirmed.</p> <p>5. Banks — Consideration—Contract—Powers.—The receipt of money by the cashier of a bank on deposit to be held subject to instructions, is a sufficient consideration to hold the bank to the performance of the conditions, and the cashier could so receive it.</p>
