Syllabus

<p>1. The only way that the evidence used in a common law action can be brought before this court, is by incorporating it in a bill of exceptions signed by the Circuit Judge.</p> <p>2. The court will in an appeal, when there is no bill of exceptions taken, inspect the record, and if there be no error apparent thereon willj affirm the judgment of the court below.</p>
