Syllabus
<p>Where the Fuel Administration, under the act of August 10, 1917, 40 Stat. 276, 284, has fixed the maximum price at which coal shall be sold by any producer thereof, it is not a taking of private property for public use under the fifth amendment, from which a promise by the Government to pay the difference between the price so fixed and just compensation, in sales to private customers, can be implied.</p>
