Syllabus

<p>Landlord and tenant — Lease—Written instrument.</p> <p>No particular words are necessary to constitute a lease, or to create the relation of landlord and tenant. Any language by which the possession is transferred for a limited time, for a stipulated return, creates a tenancy and is in effect a lease.</p> <p>Where an owner of land gives by an instrument in writing to another, the right to erect and maintain bill boards on the land mentioned in the writing, for one year, with the right of continuance thereafter from year to year, the relation of landlord and tenant is created by the writing, and if the tenant continues to maintain the bill boards on the land after the termination of the first year, he is a tenant from year to year, and is entitled to three months’ notice to quit before the close of the year.</p>
