Syllabus

<p>1. Under the special act of March 25, 1873, P. L. 376, the city of Chester had power to make a lawful contract with the P. W. & B. R. Co. by which, in consideration of a bridge of a specified character on Pennell street over the railroad crossing, to be erected and donated by the company, the grade of the street should be fixed and established so that the street when opened and used over said bridge should cross the railroad at such a height as to permit the free operation of the railroad thereunder ; by such contract the city was bound as if it were an individual, and the rights secured to the company thereby are inviolable.</p>
