In this partition action, the defendant, Sandra Karasuk Puchalski (defendant), appealed from several orders of the Superior Court that dismissed her earlier appeals, quashed and removed her statement from the Charlestown Land Evidence Records, and granted the court-appointed commissioner's petition for instructions. On appeal, the defendant argued that she did not receive adequate notice of the pertinent motions underlying her various appeals. The Supreme Court determined that the defendant had received sufficient notice in each instance. Additionally, the Supreme Court held that the orders granting the plaintiffs' motion to quash and the commissioner's petition for instructions were interlocutory and not subject to review. The Court also held that the hearing justice did not abuse her discretion in dismissing the defendant's earlier appeals. Accordingly, the Supreme Court affirmed the orders of the Superior Court.
