Syllabus

<p>Where a motion for a nonsuit was improperly denied, and the defendant subsequently introduced testimony supplying the defect in the plaintiff's evidence: Held, that the defendant thereby cured the error.</p> <p>When a statute assumes to specify the effects of a certain provision, Courts will presume that all the effects intended by the law-maker are stated.</p> <p>A sheriff is not protected in the sale of personal property by the verdict of the jury on a trial of the right of property, under the provisions of section 218 of the Code.</p> <p>The proceedings before the sheriff, in such a trial, are not judicial.</p>
