<p>SYLLABUS.</p> <p>1. Motions for continuance are ordinarily to be decided by tbe trial court, and bis discretion, viewed from tbe facts, is not ordinarily to be reviewed.</p> <p>2. Tbe conduct of tbe insurance company in charging tbe premium to tbe agent and tbe act of tbe agent in taking a note to bimself, operated as a transfer of tbe insured’s indebtedness to tbe agent, and consequently as a payment to tbe company.</p> <p>3. Evidence examined and held that anwers of insured at the medical examination were true.</p>
