Syllabus

<p>Being Twice in Jeobabdy fob a Cbime.—If a person is indicted for manslaughter, and on his trial, the Court, without the consent of the defendant, discharges the jury because it is of opinion that the evidence shows that the defendant is guilty of murder, and the defendant is again indicted for murder for the same killing, he is 1 ‘ twice put in jeopardy for the same offense,” and is entitled to an acquittal.</p>
