Syllabus

<p>Oral Instructions. — In a criminal case, if the jury, after having retired to consider of their verdict, return into Court and request to be further instructed as to the law of the case, it is error per se for the Court, in the absence of the phonographic reporter, to instruct them orally without the consent of the respective counsel.</p>
