Syllabus

<p>Application for a Writ of Mandamus.</p> <p>1. Marquette County — statute construed. The county of Marquette was absolutely created by the first section of the “ act to create the county of Marquette,” etc.; and it was not left optional with’the inhabitants to organize or not; but whether or not, it is absolutely separated, forelection purposes, from the county of Adams.</p> <p>2. Same.' The jurisdiction of Adams county, for the purposes of county government, did not extend over the county of Marquette on the 7th day of August, 1843.</p> <p>3. Municipal corporation — legislative control. The legislature has absolute control over municipal corporations, to create, change, modify, or destroy them at pleasure.</p> <p>4. SAME — non user of franchise. A public corporation, such as county or city, does not become dissolved by the neglect of the inhabitants or corporators to elect officers.</p>
