Syllabus
<p>A preliminary injunction was awarded by the court below, on a bill filed by a railroad company against a borough and its officers, to restrain defendants from interfering with the laying of a second track upon land acquired by the plaintiff company’s lessor from the commonwealth, but which had been permissively used as a passage-way by the public for more than twenty-one years: affirmed.</p>
