<p>1. Trespass — A Complaint states a cause of action when it alleges that defendant on the public highway seized plaintiff's team and wagon, with its contents, and took them off and detained them.</p> <p>2. Ibid. — Ibid.—Damages.—Damages claimed for an alleged trespass, and the kind and amount of damages form no part of plaintiff’s cause of action, and cannot be considered in determining the question raised by a demurrer to the complaint for alleged failure in stating facts sufficient to constitute a cause of action.</p>
